According to an article in Virginia Lawyers Weekly, a divorce case in Virginia Beach between a Mrs. Sheehy and her husband Mr. Randolph led to an unexpected outcome. It seems Mr. Randolph had a girlfriend named Renee Williams. The girlfriend had a Nest security camera in her home. Mr. Randolph had accessed his girlfriend’s camera to communicate with her. As a result, when his wife, who also had a Nest camera, updated her own Nest account, she was able to access the girlfriend’s Nest camera. When she did, she saw her husband and his girlfriend engaging in sexual activity. Mrs. Sheehy filed for divorce and her lawyer, in a deposition of the girlfriend, showed the girlfriend screen shots taken from the Nest camera. The judge found that the wife’s use of the naked photographs violated Virginia’s revenge porn statute. The judge ordered the wife to pay the girlfriend $20,000 in damages and further ordered her to pay $30,845 in attorney’s fees.
