In the complex health care environment, physicians and other healthcare professionals are faced with numerous legal issues. With over 20 years of experience representing physicians and other healthcare professionals, the lawyers at Davidson & Kitzmann have developed a deep understanding and experience in effectively navigating through legal issues often faced by medical professionals.
Physician Employment Contracts
Physician employment contracts present a very important and unique body of financial, job security, and lifestyle issues. Clarity in compensation, understanding whether on-call and other obligations are reasonable, and non-competition and malpractice insurance concerns are some of the many issues that often need to be addressed in physician employment contracts. Doctors and other healthcare providers should have their employment contracts reviewed by experienced counsel.
A non-competition agreement (“non-compete”) is a contract, or sometimes a clause within a larger employment contract, in which you promise not to compete with your employer after you leave your job. Each non-competition agreement (or clause) is written differently. Some are narrow and reasonable; others are very broad and incredibly damaging to a career. Violating them is an enormous legal risk.
You should always seek advice from a lawyer before signing any non-compete. If you have already signed one, you should seek advice from a lawyer before taking any action that might violate that non-compete. You need advice on your best options, your legal risks, and how to plan for your future.
Medical Board Disciplinary Proceedings
We have counseled and represented many healthcare professionals who have come under investigation by a licensing board, including the Virginia Department of Health Professions’ Board of Medicine, Board of Nursing, and Board of Pharmacy. With this experience, we can provide our clients with advice and counsel and help them protect their license and reputation.
