The Fair Labor Standards Act (FLSA) requires employers to pay certain employees for all of their hours worked, especially when those hours should be time-and-a-half overtime hours. Unfortunately, many employers routinely violate the FLSA.
Frequently, employers will fail to pay overtime to employees who are entitled to overtime compensation, such as by refusing to pay workers when they work through lunch or from home, for travel time, for time worked at the beginning and end of their shift or time worked in excess of 40 hours.
Other times, employers improperly classify employees as “exempt” from the overtime rules. One way employers do this is by classifying certain employees as “managers” despite the fact that their primary job duties are not managerial in nature.
